Grievance Committee
All homeowners and their guests, tenants, and invitees are bound by the association’s governing documents. The governing documents generally include the declaration, articles of incorporation, bylaws, and rules and regulations of the association. Florida law authorizes an association to levy reasonable fines to enforce the governing documents of a community.
The Grievance Committee is comprised of at least three (3) members of the DeBary Plantation Community Association. These homeowners are appointed and voted on by the Board of Directors and cannot be officers, directors, or employees of the association, or the spouse, parent, child, brother, or sister of an officer, director, or employee.
This is the last step of the compliance process before a fine is added to a homeowner’s account. The Grievance Committee provides the homeowner an opportunity to appear before them to present their side of the story before a violation fine is final.
At the hearing, the homeowner is afforded basic due process, allowing the homeowner to be heard, state their case, and the opportunity to challenge evidence from the Management Company. The Committee will decide by either “confirms” or “rejects” the fine levied by the Board of Directors. If the Grievance Committee rejects the fine, the matter is concluded. If the Committee confirms the fine, the fine is deemed to be imposed.
